Complete Sales Terms
1. Rekomo Utveckling AB COMMITMENT
Rekomo Utveckling AB undertakes, under the conditions specified below, as a commission agent at auction to sell items submitted by the seller. Rekomo Auctions has the right to sell submitted items at the auction that, according to Rekomo Auctions' assessment, will yield the best results or for any other reason is deemed most suitable.
2. SUBMISSION
2.1 The seller is responsible for having full and unrestricted ownership rights to items submitted to Rekomo Auctions for sale or, if the item is owned by a third party, for having full and unrestricted right to sell and collect funds for this item.
2.2 If the seller does not own the item submitted for sale, they must provide in writing evidence of their authority to sell the item. However, Rekomo Auctions is not obligated to verify the seller's authority to sell the item without specific reason.
2.3 Once Rekomo Auctions has decided to undertake the task of selling the item, a written/digital sales agreement shall be drawn up between Rekomo Auctions and the seller.
2.4 Rekomo Auctions reserves the right to unilaterally and without compensation to the seller withdraw from the sales assignment of a specific item if doubts arise regarding the authenticity of the item, ownership rights to the item, or other information that Rekomo Auctions deems essential.
2.5 The seller or the person submitting the item is obligated to inform Rekomo Auctions of any known defects and deficiencies in the item.
2.6 Revocation of the sales assignment must be done in writing. Under no circumstances does the seller have the right to revoke the sales assignment without the consent of Rekomo Auctions later than three days before the item is displayed to the public. If the seller revokes the sales assignment, they must compensate Rekomo Auctions for the costs of handling and valuation of the items, etc., with an amount corresponding to the sales fees according to section 4.1 calculated on the starting price.
2.7 All transportation of items to and from Rekomo Auctions is at the seller's expense and risk.
3. CATALOGING
3.1 Rekomo Auctions has full and unrestricted rights to determine how items should be described and depicted on the internet.
3.2 All photographs and images are the property of Rekomo Auctions and may be used, without specific compensation, for purposes unrelated to the sale.
3.3 The starting price is based on a market-adjusted valuation of the item before the auction. The starting price is only an assessment and guidance for buyers, and the price at which an item finally sells may significantly exceed or be below the starting price.
4. SALES FEES
4.1 For each auction item sold, a commission of 18.75%, including VAT, of the hammered price is charged, along with a fixed fee of 80 SEK, including VAT, for photography and insurance.
5. STORAGE AND INSURANCE
5.1 Items submitted are insured by Rekomo Auctions from the time of receipt against damage related to burglary, fire, or water damage, as well as theft or breakage, up to a value equal to the starting price minus sales fees or the hammered price minus sales fees, unless a specific agreement for a different insurance value has been made.
5.2 Rekomo Auctions is responsible for ensuring that submitted items are stored securely.
5.3 Rekomo Auctions cannot be held responsible for damage to picture glass and frames or for natural changes in organic materials such as paper bleaching and cracks in wood or wear and tear associated with display.
5.4 Rekomo Auctions is not obligated to compensate the seller for any damage exceeding the insurance value of the submitted item as stated in section 5.1.
5.5 Rekomo Auctions' liability for submitted items is limited to what is stated in these terms and conditions.
6. MONITORING
6.1 Monitoring refers to Rekomo Auctions monitoring, on behalf of the Seller, that items are not sold below the agreed acceptance price. The acceptance price must not exceed the starting price. The agreed acceptance price must be approved by Rekomo Auctions and confirmed in the sales agreement or in writing at a later date by agreement with Rekomo Auctions.
6.2 If an item does not reach the monitoring price or is hammered without any bids, the item is returned to the seller.
6.3 Rekomo Auctions has the right to sell an item below the monitoring price provided that the seller receives the same amount as if the sale had reached the acceptance price.
7. REPORTING
7.1 After the auction, the seller receives a written preliminary report on the auction results.
8. PAYMENT
8.1 Payment to the seller is made no later than thirty (30) days after the end of the auction, provided that full payment has been received from the buyer and that no claims, rescission, or exercise of statutory right of withdrawal has occurred. When selling to a consumer, the buyer has a statutory withdrawal period of fourteen (14) days from the time the buyer takes possession of the item. If the buyer's withdrawal period has not expired at the time of the regular payment, the payment to the Seller is delayed by five (5) bank days after the expiration of the withdrawal period, provided that the buyer has not notified Rekomo Auctions within the withdrawal period that the buyer wishes to exercise the right of withdrawal. If the buyer has notified Rekomo Auctions of this but does not return the item within the statutory time (return period), Rekomo Auctions has the right to demand performance of the purchase from the buyer. In such a case, the payment to the Seller is delayed by five (5) bank days after the expiration of the return period (i.e., up to a maximum of twenty-eight (28) days, plus five (5) bank days, from the time the buyer is deemed to have taken possession of the item).
8.2 Rekomo Auctions keeps received payments from buyers segregated in a client money account in accordance with the accounting funds act.
8.3 If the buyer has exercised the statutory right of withdrawal within the withdrawal period, the sale is rescinded, and the item is put up for sale again under the same sales conditions.

9. UNSOLD ITEMS
9.1 If an item remains unsold and no other agreement has been reached, Rekomo Auctions has the right, without prior notice, to resell the item at auction again. If the item has already been auctioned three times, Rekomo Auctions has the right to publish the item for an additional three times. Items that are not to be resold must be collected within 7 days after the auction.
9.2 If the item is not collected as per point 9.1, Rekomo Auctions has the right to donate the item to charitable purposes or resell the item at a reduced monitoring price even without the seller's written approval.
9.3 If the seller has a due debt to Rekomo Auctions, Rekomo Auctions has the right to withhold unsold items as security for the seller's payment of such debt.
9.4 In case of the seller's failure to make payment for the due debt to Rekomo Auctions, or to collect unsold items as per point 9.1, Rekomo Auctions has the right to take the following actions:
(I) Forwarding of items to a warehouse chosen by any shipping company. All transportation and warehousing costs are charged to the seller.
(II) Reselling of the item on behalf of the seller. Rekomo Auctions has full and unrestricted right to determine the auction format, starting price, and whether the item should be assigned a monitoring price or not. Rekomo Auctions has the right to deduct compensation for all claims that Rekomo Auctions has against the seller from the amounts received.
10. LIABILITY FOR DEFECTS
If Rekomo Auctions becomes liable to the buyer for defects in sold items, Rekomo Auctions has the right to claim compensation from the seller corresponding to the compensation that Rekomo Auctions may have paid to the buyer due to the defect. The seller is aware of the general terms and conditions applied by Rekomo Auctions to buyers at auctions.

12. FORCE MAJEURE
Rekomo Auctions is exempt from liability for failure to fulfill certain obligations under this agreement if the failure is due to circumstances as described below and the circumstance prevents or significantly complicates the fulfillment in due time thereof. Circumstances considered as grounds for exemption shall include, among others, acts of war, currency restrictions, scarcity of transportation, fire, government action, changes in legislation, labor disputes, general scarcity of goods, restrictions in propulsion, accidents, or equivalent circumstances. If Rekomo Auctions' fulfillment of a certain obligation is delayed by more than three months due to a force majeure circumstance, the seller may, without liability for compensation, terminate the agreement in writing.
13. DISPUTE
Disputes regarding these terms shall be settled in accordance with Swedish law in courts in Sweden.
